Andrew Brien is a problem solver who excels at getting clients out of difficult situations in an efficient, cost-effective manner.

Andrew’s practice focuses on complex civil litigation in state and federal courts across the country in numerous practice areas. Andrew has been recognized by Thomson Reuters, Super Lawyers Rising Stars in Texas and Louisiana, and has been recognized by Best Lawyers in America: Ones to Watch.

Andrew’s litigation experience at MH includes the representation of major manufacturers in complex product-liability litigation, the representation of business of all sizes in disputes concerning employment agreements, theft of trade secrets, and other labor and employment related claims, and the representation of life insurance and financial services companies in all types of matters ranging from complex coverage issues, contractual disputes, and bad faith disputes. Andrew also represents energy clients in breach of contract and collections matters, in addition to providing them with general business advice.

Prior to joining MH, Andrew was an associate at a regional firm in New Orleans. There, Andrew’s experience included a mixed litigation practice representing landowners in expropriation and condemnation claims and other property matters combined with general oil and gas litigation experience.

Andrew received his Bachelor of Science in Finance from LSU’s E.J. Ourso College of Business. After graduating from LSU, Andrew obtained a Louisiana Property & Casualty Producer License, which gives him unique perspective on insurance related issues for his clients. He then received his J.D. from Tulane University Law School where he graduated cum laude. During his time at Tulane, he externed for the Honorable John L. Weimer – now Chief Justice – at the Louisiana Supreme Court, was awarded a certificate for successful completion of Tulane’s Admiralty & Maritime Law Program, and received recognition for his pro bono service for his work in Panama as part of Tulane Law School’s Global Brigades program.

Outside of his legal practice, Andrew serves on the development and advocacy committees of the Pontchartrain Conservancy and served as class chair of his five-year reunion from Tulane Law. A Louisiana native, Andrew enjoys fishing (2009 International Grand Isle Tarpon Rodeo Best All Around Angler – Inshore Division), hunting, golfing, and spending time outdoors with his wife, two daughters, and golden retriever.

  • Obtained writ of mandamus from Texas state appellate court instructing trial court to vacate its order denying motion to enforce a forum selection clause. In re Express Delivery Enter. LLC, No. 12-23-00088-CV, 2023 WL 4681170, at *1 (Tex. App.—Tyler July 21, 2023, no pet.)
  • Obtained complete dismissal of life insurance breach of contract dispute via summary judgment.
  • Represented operators in defense of Louisiana legacy lawsuits involving historical oil and gas contamination. Led drafting of a summary judgment motion on Louisiana’s subsequent purchaser doctrine that achieved dismissal of a named plaintiff despite that another division of the same court decided the same issue interpreting the same contract in favor of the plaintiffs. Authored portions of the appellate briefs on appeal of the district court’s ruling on the subsequent purchase doctrine. The Louisiana First Circuit Court of Appeal affirmed the judgment, and the Louisiana Supreme Court denied the plaintiffs’ application for writ of certiorari.
  • Represented independent oil and gas operator in a joint operating dispute that was litigated in Harris County.
  • Assisted in the investigation and representation of an independent oil and gas operator following an explosion event.
  • Represented an independent oil and gas operator in the negotiation of various oilfield contracts, including master service agreements and dedication agreements, and advised that client regarding its procurement of various insurance covers.
  • Represented landowners in various negotiations and litigation matters involving disputes with oil and gas pipeline companies/operators for failure to pay royalties and right of ways or servitudes.
  • Successfully represented financial institution to prosecute loans, promissory notes, and guarantees against commercial entities and their principals. And successfully defended trial court’s granting of summary judgment on appeal. See e.g., Whitney Bank v. Garden Gate New Orleans, L.L.C., 17-362 (La. App. 5 Cir. 12/27/17); 236 So.3d 774.
  • Successfully prosecuted arbitration matter as second chair representing NYSE publicly traded real estate investment trust and one of the largest self-storage operators in the U.S. in contractual dispute with third party asset owners relating to over 40 properties spanning three states.
