MH Replaces Lead Counsel in $30 Million Property Dispute Six Months Before Trial
August 28, 2013
Case StudiesPlaintiff sought more than $30 million on breach of contract and bad faith claims related to the adjustment of damages allegedly caused by Hurricane Isaac. MH was retained six months before trial as lead counsel after written discovery closed. Following MH’s substitution as lead counsel, MH discovered the underlying adjuster admitted to breach of contract. Using only deposition testimony and third-party subpoenas, MH developed evidence of fraud by the Plaintiff, providing leverage for the case to settle at less than 6% of Plaintiff’s damage model prior to the claim adjuster’s deposition.
