MH Summary Judgment in $1.5M Property Matter Affirmed by Fifth Circuit
July 13, 2010
Case StudiesPlaintiffs sued Standard Guaranty for $1.5 million for breach of contract and bad faith related to the adjustment of damages allegedly caused by a hurricane. Only five months after the lawsuit was served, the district court struck the Plaintiffs’ expert and granted Standard Guaranty’s motion for summary judgment, holding in an issue of first impression that a contractor’s estimate alone is insufficient to create causation between a covered loss and claimed damages. The Fifth Circuit affirmed the summary judgment order despite the trial court’s refusal to allow Plaintiffs to perform any discovery.
