Case Studies

MH attorney Jodi K. Swick successfully represented a life insurance company in a case involving two individuals, who claimed to be entitled to a policy’s benefits, but were not named as beneficiaries of the policy. MH filed a motion for judgment on the pleadings alleging that the policies were preempted by ERISA. The district court agreed and dismissed the complaint. After the court’s ruling, plaintiffs elected not to file an amended complaint and the case resolved without payment.
