MH Wins Life Insurance Appeal in the Third Circuit

The U.S. Court of Appeals for the Third Circuit recently affirmed a complete motion for summary judgment decision on behalf of MH’s insurance client.

In the initial suit, filed in the U.S. District Court for the Eastern District of Pennsylvania, the plaintiff brought several claims including breach of contract, fraudulent misrepresentation, negligent misrepresentation, and violation of Pennsylvania’s Unfair Trade Practices & Consumer Protection Law (“UTPCPL”). These claims centered on a dispute regarding the conversion options of a previously offered, and ultimately phased out, insurance product. The plaintiff alleged misrepresentation and withholding of information on several fronts, including MH’s clients’ call center customer service representatives. MH navigated this complex set of facts to a successful MSJ decision.

After briefing and oral argument, the Third Circuit upheld the district court’s decision – a significant reaffirmation and victory for MH’s client.
