MH Wins Solar Energy Arbitration
McDowell Hetherington won an arbitration for its client, a leading solar energy company, after a multi-day hearing that took place in Houston in January 2020. The case was a complex dispute with a contractor over construction and production issues related to several large solar energy systems. The contractor filed the case seeking $880,000 for unpaid work and allegedly lost profits. MH’s client claimed a right to offset based on the contractor’s defective work and counterclaimed for an additional $575,000. The arbitrator’s final award denied the contractor’s claims in full and awarded MH’s client 100% of the damages it requested, along with its attorney’s fees and arbitration costs. MH lawyers Matt Matthews and Nick Lawson arbitrated the case.
